Please read these terms carefully before using our services

1. Introduction & Acceptance

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you", "your", or "the customer") and Pinecreek Restaurant & Farmstall ("Pinecreek", "we", "us", or "our"), located at R102 Old Gonubie Road, Holm Hill, Beacon Bay, East London, 5201, Eastern Cape, South Africa.

These Terms govern your use of the Pinecreek website (pinecreek.co.za), WiFi captive portal, QR table ordering system, kiddies party bookings, loyalty programme, and all related digital services (collectively, "the Services").

By accessing or using any of our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of our Services immediately.

These Terms are subject to the Consumer Protection Act 68 of 2008 ("CPA"), the Protection of Personal Information Act 4 of 2013 ("POPIA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and all other applicable South African legislation.

2. Definitions

  • "Services" means the Pinecreek website, WiFi captive portal, QR table ordering system, kiddies party booking system, loyalty programme, and all related digital services.
  • "Account" means a registered user account created on our website or WiFi captive portal.
  • "QR Ordering" means the digital table ordering system accessed by scanning a QR code at our venue.
  • "Payment Gateway" means the third-party payment processing services (including PayFast and Ozow) used to process online payments.
  • "PosiTack" means the third-party point-of-sale and ordering platform that powers our QR ordering, loyalty programme, and party booking systems.
  • "Personal Information" has the meaning ascribed to it in POPIA.

3. Website Account Terms

When you register for an account on our website or WiFi portal, you agree to the following:

  • You must provide accurate, current, and complete information during registration.
  • Only one account may be created per email address. Email addresses are treated as case-insensitive.
  • You are solely responsible for maintaining the confidentiality of your password and account credentials.
  • Passwords must be at least 8 characters long and contain both letters and numbers.
  • You must notify us immediately of any unauthorised use of your account or any security breach.
  • You may not share, transfer, or allow another person to use your account.
  • We reserve the right to suspend, restrict, or terminate any account at our sole discretion if we reasonably believe a violation of these Terms has occurred.
  • You may request deletion of your account at any time by contacting us. Deletion will be processed in accordance with our Privacy Policy and applicable data retention requirements.

4. WiFi Usage Terms

Our complimentary WiFi service is provided as a courtesy to guests visiting Pinecreek Restaurant & Farmstall. By connecting to and using our WiFi network, you agree to the following:

  • WiFi access sessions are valid for 24 hours from the time of authentication and expire automatically.
  • Your device MAC address and IP address are recorded and stored for the purposes of network management, security, and access control.
  • You may not use the WiFi service for any unlawful, illegal, or prohibited activities under South African law.
  • You may not attempt to access, probe, scan, interfere with, or disrupt our network infrastructure, connected devices, or any other system accessible via our network.
  • Downloading, uploading, or distributing copyrighted material without proper authorisation is strictly prohibited.
  • Accessing, distributing, or transmitting any obscene, offensive, threatening, or harmful material is prohibited.
  • Excessive bandwidth usage that negatively impacts the experience of other guests may result in immediate disconnection without notice.
  • We reserve the right to monitor network traffic for security purposes and to enforce these Terms.
  • You may not use the WiFi service to send unsolicited bulk messages (spam), conduct phishing attacks, or engage in any form of cybercrime.

Disclaimer of Warranty

The WiFi service is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, availability, speed, security, or non-infringement. We do not guarantee uninterrupted or error-free service. You connect to and use our WiFi network entirely at your own risk.

5. QR Table Ordering

Our QR table ordering system allows you to place food and beverage orders directly from your table. By using this service, you agree to the following:

Placing Orders

  • Orders placed through the QR system constitute a binding offer to purchase the selected items at the prices displayed at the time of ordering.
  • All prices displayed are in South African Rand (ZAR) and include Value-Added Tax (VAT) where applicable.
  • Menu items, descriptions, availability, and prices are subject to change without prior notice. We make reasonable efforts to ensure accuracy but do not guarantee that all items displayed will be available.
  • We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of pricing errors, item unavailability, suspected fraud, or system errors.
  • You are responsible for ensuring the accuracy of your order, including item selections, options, and special instructions, before submitting.
  • Once submitted, orders cannot be modified or cancelled through the digital system. Please speak to a staff member if you need to make changes.
  • Cart data is stored locally on your device and expires automatically after 2 hours of inactivity.

Order Limits

  • A maximum of 20 units per individual item may be added to a single order.
  • We reserve the right to impose additional order limits at our discretion.

Geolocation Verification

Our QR ordering system may request access to your device's location to verify that you are physically present at our venue. This is a fraud prevention measure. Where geolocation is required in strict mode, you will not be able to complete your order without granting location access. Your location coordinates are sent to our ordering platform (PosiTack) as part of your order data and may be retained as part of the order record. In lenient mode, you may decline location access and your order will proceed without location verification.

6. Payments & Pricing

Payment Methods

We offer the following payment methods for QR orders:

  • Pay at Till — You pay in person at the till point located in our Farmstall or Tuckshop. All standard payment methods (cash, card, etc.) are accepted.
  • Online Payment — Processed through third-party payment gateways including PayFast and Ozow. By selecting online payment, you agree to the terms and conditions of the relevant payment gateway provider in addition to these Terms.

Third-Party Payment Processors

Online payments are processed by independent third-party payment gateways. When you choose to pay online, you will be redirected to the payment provider's secure platform. Pinecreek does not store, process, or have access to your full credit card details, bank account numbers, or other sensitive payment credentials. All payment data is handled directly by the payment provider in accordance with their security standards and privacy policies.

  • PayFast (Pty) Ltd — Processes credit/debit card payments. Subject to PayFast's terms of service and privacy policy.
  • Ozow (Pty) Ltd — Processes instant EFT / bank transfer payments. Subject to Ozow's terms of service and privacy policy.

Pricing & Accuracy

  • All prices are quoted in South African Rand (ZAR) and include VAT.
  • While we make every effort to ensure pricing accuracy, errors may occur. In the event of a pricing error, we reserve the right to cancel the order and offer a full refund.
  • Prices are subject to change without prior notice. The price at the time of order submission is the price that applies to your transaction.

Refunds & Cancellations

  • Once an order is submitted and accepted by our kitchen, it generally cannot be cancelled. Please speak to a staff member for assistance.
  • Refunds for online payments will be processed through the original payment method and may take 5–10 business days to reflect, depending on your bank or payment provider.
  • If your order cannot be fulfilled due to item unavailability after payment, you will receive a full refund for the affected items.
  • In accordance with the CPA, you are entitled to return goods that are defective, unsafe, or not of a quality reasonably expected. We encourage you to raise any concerns about food quality or safety with staff while you are still at our venue so we can address them promptly. However, this does not limit your rights under section 56 of the CPA to report defective or unsafe goods within a reasonable time after discovery.
  • Refund requests should be directed to our staff on the premises or via our contact details below.

7. Alcohol & Age Verification

In compliance with the South African Liquor Act 59 of 2003 and the National Liquor Act 27 of 1989:

  • You must be 18 years of age or older to purchase or consume alcoholic beverages.
  • When ordering alcoholic items through our QR ordering system, you will be required to confirm your age via a digital age verification prompt before the order can be placed.
  • By confirming your age, you declare under penalty of law that you are 18 years of age or older.
  • We reserve the right to refuse the sale of alcohol to any person who appears to be under the age of 18 or who is visibly intoxicated, in accordance with South African law.
  • It is a criminal offence to misrepresent your age to purchase alcohol. While our digital age verification serves as a compliance measure, Pinecreek retains all obligations as a licensed liquor vendor under the Liquor Act 59 of 2003. The digital age verification prompt does not substitute for physical verification by staff, which may be conducted at the point of delivery.
  • Pinecreek holds a valid liquor licence and all alcohol sales are conducted in compliance with applicable liquor regulations.

8. Kiddies Party Bookings

Our kiddies party booking system allows you to reserve party packages at our venue. By making a booking, you agree to the following:

  • Party bookings are subject to venue and time-slot availability.
  • A deposit or full payment may be required at the time of booking, depending on the selected package and payment settings. Deposits are processed through our online payment gateways.
  • Booking confirmations will be sent to the email address provided. It is your responsibility to ensure the email address is correct.
  • The parent or guardian making the booking assumes full responsibility for all children attending the party and their behaviour at our venue.
  • Guest counts provided at the time of booking must be as accurate as possible. Additional guests beyond the booked number may incur extra charges.
  • Pinecreek reserves the right to refuse entry or terminate a party event if guests behave in a manner that is dangerous, disruptive, or in violation of venue rules.
  • Party packages, pricing, inclusions, and available venues are subject to change. The package details confirmed at the time of booking will apply.

Cancellation of Party Bookings

  • Cancellation policies, including deposit refund terms, will be communicated at the time of booking and are determined by the applicable party settings.
  • Cancellations must be made via our website or by contacting us directly.
  • Failure to arrive for a confirmed booking without prior cancellation ("no-show") may result in forfeiture of any deposit paid.
  • Pinecreek reserves the right to cancel a booking due to unforeseen circumstances (e.g., severe weather, facility damage, or public health restrictions). In such cases, a full refund or alternative date will be offered.

9. Loyalty Programme

  • Our loyalty programme is operated by PosiTack, a third-party service provider. By participating, you agree to PosiTack's terms of service in addition to these Terms.
  • Participation in the loyalty programme is entirely voluntary.
  • Loyalty points, rewards, and programme rules are determined by PosiTack and Pinecreek jointly and may be modified, suspended, or discontinued at any time without prior notice.
  • Loyalty points have no cash value and cannot be exchanged for cash, transferred to another person, or combined across separate accounts.
  • Pinecreek reserves the right to revoke loyalty points or rewards obtained through fraud, system errors, or abuse of the programme.
  • When you create a Pinecreek website account, your account may be automatically linked to the PosiTack loyalty system to provide a seamless experience. You may opt out by contacting us.
  • To enable seamless access to ordering, loyalty, and party booking features, your account credentials (stored as a secure hash, never in plaintext) are synchronised with the PosiTack platform. This synchronisation occurs automatically when you register, log in, or reset your password.
  • Pinecreek is not liable for any technical issues, data loss, or service interruptions within the PosiTack platform.

10. Third-Party Services

We rely on third-party service providers to deliver certain aspects of our Services. By using our Services, you acknowledge and accept the involvement of the following third parties:

  • PosiTack — Powers our QR ordering system, loyalty programme, party bookings, and order tracking. Your order details, contact information, and loyalty data are processed by PosiTack.
  • PayFast (Pty) Ltd — Processes online card payments. Your payment details are handled directly by PayFast on their secure servers.
  • Ozow (Pty) Ltd — Processes instant EFT payments. Your banking session is handled directly by Ozow.
  • Meta Platforms (WhatsApp Business API) — Used to deliver one-time passwords for password resets. Your phone number is shared with Meta solely for this purpose.
  • MikroTik — Our WiFi network management hardware. Your device MAC address and IP address are processed locally on our network equipment.

Pinecreek is not responsible for the privacy practices, security, terms of service, availability, or actions of any third-party service provider. Your use of third-party services is governed by their respective terms and policies.

We do not sell, rent, or trade your personal information to any third party for marketing purposes.

11. Data Storage on Your Device

Our Services use your browser's local storage, session storage, and cookies to provide essential functionality, analytics, and marketing features. For a complete breakdown, see our Cookie Policy. The essential items stored on your device include:

  • Authentication tokens (JWT) — Stored in localStorage to keep you logged in. Access tokens expire after 1 hour; refresh tokens after 30 days.
  • Cart data — Your QR order cart contents are stored in localStorage and automatically expire after 2 hours of inactivity.
  • Age verification status — Stored in sessionStorage for the duration of your ordering session to avoid repeated verification prompts.
  • PosiTack authentication tokens — Stored in localStorage to maintain your connection to the loyalty and ordering platform.

By using our Services, you consent to the storage of these data items on your device as described in our Privacy Policy. You may clear this data at any time by clearing your browser's site data. Doing so will log you out and clear your cart.

12. Intellectual Property

  • All content on this website — including but not limited to text, images, photographs, logos, graphics, menu designs, page layouts, and software — is the property of Pinecreek Restaurant & Farmstall or its licensors and is protected by the Copyright Act 98 of 1978 and other applicable South African intellectual property legislation.
  • The Pinecreek name, logo, and branding are trademarks of Pinecreek Restaurant & Farmstall. Unauthorised use is prohibited.
  • You may not reproduce, distribute, modify, publicly display, create derivative works from, reverse-engineer, or commercially exploit any content from this website without our prior written consent.
  • You are granted a limited, non-exclusive, revocable licence to access and use our website for personal, non-commercial purposes only.
  • Any feedback, suggestions, or ideas you submit to us regarding our Services may be used by us without any obligation of compensation or attribution.

13. Acceptable Use

You agree not to:

  • Use our Services for any purpose that is unlawful, fraudulent, or prohibited by these Terms.
  • Attempt to gain unauthorised access to any part of our Services, servers, systems, or networks.
  • Use automated systems, bots, scrapers, or scripts to access or interact with our Services without our written permission.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity, performance, or availability of our Services.
  • Submit false, misleading, or fraudulent information, including but not limited to false age declarations, contact details, or payment information.
  • Use our Services to harass, threaten, defame, or abuse any person.
  • Attempt to circumvent any security measures, rate limits, or access controls implemented on our Services.

Violation of these acceptable use terms may result in immediate suspension or termination of your account and access to our Services, without prior notice or liability.

14. Limitation of Liability

To the maximum extent permitted by South African law, including the CPA:

  • Our Services, including the website, WiFi, and QR ordering system, are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
  • We do not warrant that our Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
  • Pinecreek, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services.
  • We are not liable for any loss of data, profits, revenue, or business opportunities arising from the use of our Services.
  • We are not responsible for any data loss, unauthorised access, or security breaches that occur while using our WiFi network.
  • We are not liable for any delays, failures, or errors in processing orders or payments caused by third-party service providers, network failures, or circumstances beyond our reasonable control.
  • Our total liability to you for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid to us in the 3 months immediately preceding the event giving rise to the claim.
  • Notwithstanding any provision of these Terms, nothing herein excludes or restricts your statutory rights under the Consumer Protection Act 68 of 2008, including but not limited to your right to fair and honest dealing (section 40), your right to goods of acceptable quality (section 55), your right to return defective goods (section 56), and your right to an implied warranty of quality. Any clause in these Terms that purports to limit these rights shall be void to the extent of such limitation.
  • Nothing in these Terms excludes or limits liability that cannot be excluded or limited under South African law, including liability for death or personal injury caused by negligence or for fraud.

15. Indemnification

You agree to indemnify, defend, and hold harmless Pinecreek Restaurant & Farmstall, its owners, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to our Services.
  • Your violation of these Terms or any applicable law or regulation.
  • Your violation of any third-party rights, including intellectual property rights or privacy rights.
  • Any content or information you provide through our Services.
  • Any false age declaration made in connection with the purchase of alcohol.

16. Privacy & POPIA

We are committed to protecting your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). Our full Privacy Policy details how we collect, use, store, and protect your personal information.

  • We collect only the personal information necessary to provide our Services.
  • Your personal information is processed lawfully and for legitimate purposes only.
  • We implement appropriate technical and organisational security measures to protect your data.

  • You may lodge a complaint with the Information Regulator of South Africa if you believe your rights have been infringed.
  • We do not sell your personal information to third parties.

17. Dispute Resolution

  • Any dispute, controversy, or claim arising out of or relating to these Terms or our Services shall first be addressed through informal negotiation. You agree to contact us in writing and allow a period of 30 days to resolve the matter before pursuing formal remedies.
  • If the dispute cannot be resolved through informal negotiation, either party may refer the matter to mediation administered by a mutually agreed-upon mediator in East London, Eastern Cape.
  • If mediation fails, the dispute shall be subject to the exclusive jurisdiction of the Magistrate's Court or High Court of East London, Eastern Cape, Republic of South Africa.
  • Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction.
  • For consumer complaints, you may also contact the National Consumer Commission (NCC) or the relevant consumer court in terms of the CPA.

18. Governing Law

  • These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
  • The Consumer Protection Act 68 of 2008 (CPA) applies to all consumer transactions.
  • The Electronic Communications and Transactions Act 25 of 2002 (ECTA) applies to all electronic transactions and communications conducted through our Services.
  • The Protection of Personal Information Act 4 of 2013 (POPIA) governs all processing of personal information.
  • The Liquor Act 59 of 2003 applies to the sale and supply of alcohol.

19. General Provisions

  • Severability — If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
  • Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pinecreek with respect to the use of our Services, and supersede all prior or contemporaneous agreements, understandings, or representations.
  • Waiver — Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any term shall be effective only if in writing and signed by Pinecreek.
  • Assignment — You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Pinecreek may assign its rights and obligations without restriction.
  • Force Majeure — Pinecreek shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, power failures, internet outages, government actions, or civil unrest.
  • Headings — Section headings in these Terms are for convenience only and shall not affect the interpretation of any provision.

20. Changes to These Terms

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to this page. The "Effective date" at the top of these Terms will be updated to reflect the date of the most recent revision.

Your continued use of our Services after any changes to these Terms constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically for any changes.

For material changes that significantly affect your rights, we will make reasonable efforts to provide notice, such as displaying a prominent notice on our website.
